Please read the following Terms of service carefully before accessing or using our facilities. By the use of our facilities and services you agree to be bound by those Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not use our premises or services. Acceptance is expressly limited to these terms of services and use.
Any new features or tools which are added to the current premises shall also be subject to the Terms of service. We reserve the right to update, change or replace any part of these Terms of service at any time.
By agreeing to these Terms of Service, you represent that you are at least the age of the majority in the State of New York (18 years or older). You represent all individuals entering this property through your own services. You have given us consent to allow any of your minor dependents as well as yourself to use our premises. Therefore, you are fully responsible for all individuals of minor or majority age and will in no way hold the host/ess (Vendor) Liable in the event of any unforeseen mishap of occurrences.
You may not use our premises for any illegal or unauthorized purpose, nor may you in the use of the services, violate any laws in your jurisdiction.
It is clearly expressed and understood that only services and products agreed on are to be of used by our guests. If residue from body adornments or sunscreen is left in the hot tub or pool, there is a $130 cleaning fee.
We reserve the right to refuse service to anyone for any reason at any time. You agree to not exploit any portion of our services. We have made every effort to display as accurately as possible all services offered: all queries or misunderstandings can be resolved with questions.
We reserve the right to limit quantities of persons or services entering our facilities or premises as well as what we offer. This individual agreement will allow a capacity of 8 individuals. Additional individuals will be charged thirty dollars ($30) per person (This includes children and adults). Final capacity not to exceed twelve (12) people. All descriptions of services or service pricing are subject to change at any time at the sole discretion of us. We may provide you with access to third-party tools over which we neither monitor nor have any control or input.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. You expressly agree that your use of or inability to use the service is at your sole risk. In no case shall sample affiliates, employees, suppliers, agents, contractors, suppliers of service providers be liable for injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind; Including, with limitation lost profits, lost revenue, lost savings, loss of data, replacement cost, or based on contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the services. Or for any other claim related in any way to your use of the service or any product, including but not limited to any errors or omissions in any content. This further includes any loss or damage of any kind incurred because of the use of the service or any content, even if advised of their possibility.
You are prohibited as set forth in the Terms of services from using our premises for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; to infringe upon or violate our intellectual property rights or the intellectual property rights of others. To harass, abuse, insult, harm, deform, slander, disparage, intimidate, or discriminate based on gender, sexual origin, or disability. To submit false or misleading information. For any obscene or immoral purpose. We reserve the right to terminate your right to use of service for violating any prohibited uses.
You agree to indemnify, defend and hold harmless sample, subsidiaries, affiliates, directors’ agents, contractors, service providers, employees, harmless from any claim or demand, including reasonable attorney’s fees due to or arising out of your breach of these Terms of service. In the event that any provision of these Terms of Services is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permissible by applicable law.
Furthermore, any fees, tariffs, levies, dues, costs, or bills incurred or occurred is expected to be fully concluded within two (2) days of occurrence. This does not include initial service fees, which is expected in full on the day of desired event. Including a security deposit of $150. Please keep in mind this deposit may not cover all damages, including property, hot tub, or pool cleaning fee. The expectation of 100% down payment at LEAST/NOT AFTER a week before the date of occupancy. A copy of your identification card is required at the signing of this contract/waiver.
The total cost of services will be calculated including an additional security deposit of $150 which will be returned if there are no incidentals. As previously stated, incidentals may exceed the cost of $150 and as part of this contract you are required to cover.
Please respect our check in and check out times. Check in at 3pm and check out at 11am.
Pets allowed for additional fee of $50.
No unregistered guests are allowed.
Please be mindful of the noise level as this is a residential neighborhood.
No smoking is allowed as well as the use of illegal substances as already stated.
There are to be no unauthorized parties.
Please don’t drink or eat in the bedrooms.
Please clean up after yourself.
Please turn off all lights when you go out.
Please do not rearrange the furniture.
Please respect and follow the hot tub rules as stated on the left side of the backyard fence beside the hot tub.
These Terms of service are effective unless and until terminated by either you or us. You may terminate these Terms of service at least two weeks before event activities by notifying us that you no longer wish to use our services which would bring you at a loss of 50%. The service constitutes the entire agreement and understanding between you and us and governs your use of the service. Any ambiguities in the interpretation of these Terms of Services shall not be construed against the drafting party. Consequently, all questions, queries or concerns are welcome in order to establish clarifications. Use of the services is an interpretation that all parties on the contracting consumers end are fully informed and have complied to the Terms of services.
